1 About Costimo.ai

Costimo.ai is a construction project cost platform intended to support:

• Cost estimation, resource analysis, and budget preparation
• Budget conversion, control, and cost tracking
• Variance monitoring and project cost governance
• Related construction cost-management workflows

2 User Accounts

Users may be required to create an account to access the platform. Users are responsible for:

• Providing accurate account information
• Maintaining confidentiality of login credentials
• Ensuring that only authorised persons access the account
• Managing user roles and permissions within their organisation
• Promptly notifying us of any unauthorised access or suspected breach

We may suspend or restrict access if we reasonably believe that an account is being misused or accessed in an unauthorised manner.

3 Organisation Use

Where an account is created or used for a company, contractor, consultant, client, or other organisation, the organisation is responsible for all activities conducted through its authorised users. The organisation shall ensure that its users comply with these Terms.

4 User Data and Project Data

Users may create, upload, import, or process project data, estimates, budgets, resources, cost records, vendor rates, documents, and related information. Users retain responsibility for the accuracy, legality, completeness, and reliability of such data.

Costimo.ai does not claim ownership of user-created project data. However, users grant Costimo.ai the limited right to process, host, store, transmit, display, and back up such data as required to provide the services.

5 Accuracy of Estimates and Outputs

Costimo.ai may generate calculations, reports, cost summaries, rate-analysis outputs, budget conversions, cost-control dashboards, or other project-cost information. All such outputs are provided as decision-support information only.

Users are responsible for independently verifying all quantities, rates, productivity assumptions, resource requirements, taxes, overheads, margins, contractual provisions, local market conditions, project-specific risks, and applicable standards before relying on any platform output.

6 Acceptable Use

Users shall not:

• Use the platform for unlawful purposes
• Attempt unauthorised access to systems, data, or accounts
• Interfere with platform security or performance
• Upload malicious code, viruses, or harmful files
• Reverse engineer, copy, or misuse the platform
• Use automated scraping or abusive traffic
• Upload data without the right or authority to do so
• Violate intellectual-property rights or confidentiality obligations
• Use the platform in a manner that may damage Costimo.ai or other users

7 Confidentiality

Users may process confidential commercial and project information through Costimo.ai. Costimo.ai will take reasonable steps to protect such information. Users must ensure that access rights are properly controlled within their organisation and that confidential information is uploaded only where authorised.

8 Intellectual Property

Costimo.ai, including its software, interface, design, workflows, templates, databases, standard libraries, logos, trademarks, documentation, and proprietary methods, is owned by Costimo.ai or its licensors. Users shall not copy, reproduce, modify, distribute, sell, sublicense, or create derivative works from Costimo.ai except as expressly permitted. User-created project data remains the responsibility of the user or subscribing organisation.

9 Standard Libraries and Reference Data

Costimo.ai may provide standard resource libraries, assemblies, templates, rate-analysis structures, productivity references, or sample cost data. Such data is provided for reference and convenience only. Users must review, validate, and adjust all such information before use in actual tenders, budgets, contracts, procurement, execution, or cost-control decisions.

10 Subscription, Fees, and Payments

Certain features may be offered under free, trial, paid, subscription, or enterprise plans. Where fees apply, users agree to pay the applicable charges in accordance with the selected plan, invoice, proposal, or agreement. Unless expressly agreed otherwise, fees are non-refundable once services are activated or made available. Additional commercial terms may be agreed separately in writing for enterprise customers.

11 Availability and Changes

We aim to maintain reliable access to Costimo.ai. However, we do not guarantee uninterrupted, error-free, or permanent availability. We may modify, suspend, improve, restrict, or discontinue features from time to time for maintenance, security, business, legal, or technical reasons.

12 Third-Party Services

Costimo.ai may integrate with or rely upon third-party services for hosting, authentication, storage, analytics, payment, communication, artificial intelligence, or other infrastructure functions. We are not responsible for outages, changes, data handling, or service limitations of third-party providers beyond our reasonable control.

13 Limitation of Liability

To the maximum extent permitted by applicable law, Costimo.ai shall not be liable for:

• Loss of profit, revenue, or business opportunity
• Loss of tender or contract, or project cost overrun
• Incorrect estimate, budget, or cost-control output
• Loss of data or indirect, incidental, special, or consequential damages
• Claims arising from user reliance on unverified platform outputs

The platform is provided on an "as available" and "as is" basis, subject to the express terms agreed with the user or organisation.

14 Indemnity

Users agree to indemnify and hold Costimo.ai harmless from claims, damages, liabilities, costs, or expenses arising from misuse of the platform, breach of these Terms, upload or use of unauthorised data, violation of third-party rights, reliance on unverified outputs, or unauthorised access caused by failure to protect credentials or permissions.

15 Termination or Suspension

We may suspend or terminate access where these Terms are breached, fees remain unpaid, the platform is misused, security risks are identified, or continued access may expose Costimo.ai or other users to legal, operational, or security risk. Users may discontinue use of the platform at any time, subject to applicable subscription or contractual obligations.

16 Governing Law

These Terms shall be governed by the laws of India, unless otherwise agreed in a separate written contract with the customer. For enterprise or international customers, governing law and dispute resolution may be separately agreed in the applicable proposal, order form, subscription agreement, or service contract.

17 Changes to Terms

We may update these Terms of Service from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use of Costimo.ai after publication of updated Terms constitutes acceptance of the revised Terms.
